Terms of Service

1. Who these terms are between

These terms are an agreement between the business that creates an IntelixServe account (“you”, the “Customer”) and Aptivix Technologies LLP (“Aptivix”, “we”). By creating a restaurant on this website, or by using the platform, you accept them on behalf of that business and confirm you are authorised to do so.

2. The service

IntelixServe is a hosted restaurant point-of-sale platform: a counter web application, a waiter application for phones and tablets, a platform console, and the APIs behind them. We may improve or change features over time; we will not remove a capability your plan depends on without reasonable notice.

3. Accounts and access

Each restaurant is a separate tenant identified by its restaurant code. The owner account can create staff logins and assign roles; you are responsible for who you give access to, for keeping passwords and PINs confidential, and for activity under your accounts. Tell us promptly if you believe an account has been compromised.

4. Trial, plans and payment

New restaurants start on the free Starter plan with the limits shown on the pricing page, for as long as they like. No payment details are required to start. To move to a paid plan, request it from inside the app; prices are per restaurant per month, exclusive of GST, and are published on the pricing page at the time you subscribe. If a paid subscription lapses, the restaurant returns to the Starter limits; nothing is deleted and your data is kept for the period in section 8. We may change prices with at least 30 days' notice, taking effect from your next billing period.

Plan limits (branches, staff logins, devices) are enforced by the platform. Exceeding them requires a higher plan.

5. Your data

You own the business data you enter: menu, tables, staff, orders, bills, payments and reports. You grant us the right to host, process and back it up to provide the service. We keep each restaurant's data isolated and do not disclose it to other customers. Our privacy policy describes how personal information is handled.

You are responsible for the accuracy of tax details — GSTIN, TIN, tax rates and bill numbering — configured in your account, and for complying with the tax and licensing laws that apply to your restaurant. IntelixServe calculates bills from the configuration you provide; it does not give tax advice.

6. Acceptable use

• Do not use the platform for anything unlawful, or to issue bills you are not entitled to issue.
• Do not attempt to access another restaurant's data, probe or overload the service, or reverse-engineer it.
• Do not share a single login among several people where roles and audit trails matter; create a login per person.

7. Availability and support

We aim to keep the service available at all times but do not guarantee uninterrupted operation. Planned maintenance is scheduled outside typical service hours where possible. Support is provided by email, phone and WhatsApp during the hours shown on the contact page; restaurants on a paid plan receive support during service hours. When you ask for help, our support staff may sign in to your account through an audit-logged session; you can see these in your audit log.

8. Suspension, termination and data export

You may cancel at any time from the platform or by writing to us. We may suspend an account for non-payment, a breach of these terms, or a security risk, and will tell you why. After cancellation or the end of an unpaid trial, we keep your data for 90 days so you can export it or reactivate; after that it is deleted, except bill records we are required to retain by law. We will export your data in a common format on request during that period.

9. Warranties and liability

The service is provided with reasonable skill and care. To the extent permitted by law, we exclude all other warranties, and our total liability under these terms in any twelve-month period is limited to the fees you paid us in that period. We are not liable for indirect losses, loss of profit, or losses caused by inaccurate configuration, third-party hardware such as printers, or failures of your internet connection or devices. Nothing in these terms limits liability that cannot be limited by law.

10. Changes to these terms

We may update these terms as the product and the law change. The date at the top shows the last revision; material changes are notified to the owner's email at least 30 days before they take effect. Continued use after that date is acceptance.

11. Governing law

These terms are governed by the laws of India. Courts in Gurugram, Haryana have exclusive jurisdiction, subject to any right you have under law to bring a claim elsewhere.
